the Court a suggestion was made from the Bench that the plaintiff should come to some arrangement with Paulus, and after Paulus, and Lai Sin had stated that the Government of Anam held property valued at $60,000 belonging to Paulus and held by Kandstein Mr. Hayllar expressed his willingness to release the "Dang wee if Paulus would enter into a bond to pay $60,000 at Anam, and if Lai Fiu would sign the bond as surety. During the negotiations in October 1874 Kai Jin had offered to be security that Paulus would carry out the offer made on his behalf at that time by the Attornies representing the King.
As Counsel for the King I declined to be a party to the arrangement lest I should be held to have submitted my clients to the jurisdiction of the Court and to have forfeited the claim made on his behalf to be compensated in Costs and damages for the illegal detention of his steamer. The position I assumed was distasteful to His Honour the Chief Justice, and shortly afterwards he abruptly left the Court. His Honour has since stated in Court that he retired because he would not countenance a compromise that did not finally dispose of the whole matter, Mr Justice Inglis remained and further questioned Lai Liu and Paulus who agreed to the proposal made by Mr Hayllar and the Court was then adjourned for a week.
Upon the 29th and 25th of April Mr Justice Snowden being alone on the Bench, and the bond having been approved and signed ordered the release of the Gangwe. I then applied to resume my argument as to
